2.8 تأثير أداء السلطات المختلفة على الفساد
2.8.1 السلطة التشريعية
هل يمكن أن تدان السلطة التشريعية بالمساعدة على نمو الفساد في ليبيا؟ إن إلغاء قوانين سابقة بدون دراسة، واستحداث قوانين حديثة بدون فلسفة تشريعية وتباين في السياسات التشريعية للسلطات المتعاقبة بما يشبه الموجات العنيفة والمتضادة في نوع من العبث التشريعي خلق بيئة مناسبة للفساد.
ومن ذلك إصدار السلطة التشريعية قوانين وقرارات تسهل بطريقة مباشرة أو غير مباشرة انتشار الفساد، أو تعرقل سبل مكافحته، ولعل من صور الفساد أن تصدر السلطة التشريعية قوانين وقرارات تقدم في صدورها المصلحة الخاصة لأعضائها على المصلحة العامة، ولا يقل خطورةً الدورُ السلبي للسلطة التشريعية في مواجهة الفساد؛ بمعنى امتناعها عن إصدار تشريعات تساعد على الحد من الفساد. فلا أدل على مساهمة السلطة التشريعية في زيادة الفساد من عجزها عن إصدار قانون خاص بمكافحة الفساد.
ولعل الفساد التشريعي صورة من صور الفساد السياسي إذ المشرع هو الخصم السياسي الذي فاز في الانتخابات، وقرر بعد أن أصبح السلطة التشريعية للبلاد أن يفصّل قوانين وتعديلات دستورية تعيق وصول خصمه للفوز بالسلطة وفقا لمبدأ الانتقال السلمي والتعددية الحزبية؛ مما يشكل عائقا حقيقيا أمام المصالحة الوطنية، ولا أدل على الفساد المقنن من قانون رقم 36 لسنة 2012 بشأن إدارة أموال وممتلكات بعض الأشخاص المعدل بالقانون رقم 47 لسنة 2012 الذي يجيز للسلطة التنفيذية التصرف في أموال أنصار النظام السابق وذويهم بدون حاجة لصدور حكم قضائي، لمجرد توافر شبهات فساد، كما ينظر الكثيرون لقانون العزل السياسي على أنه فساد سياسي مقنن.
ومن أهم صور الفساد السياسي الخطيرة تشبث الجهة القابعة في السلطة بكرسيها ومنعها الوصول السلمي بطريقة نزيهة، ولعل المشرع الليبي قد تنبه لهذا النوع من الفساد المتمثل في الانحراف عن القوانين واللوائح المنظمة للعملية الانتخابية، والبعد عن النزاهة المتطلبة لإدارتها بدون تزوير للنتائج أو ممارسة إكراه مادي ومعنوي بالترهيب أو الترغيب للعبث بالإرادة الشعبية، منذ 1985 محاولًا التصدي له بتجريمه في القانون رقم 22 لسنة 1985بشأن محاربة إساءة استعمال الوظيفة أو المهنة والانحراف بأعمال التصعيد الشعبي؛ فقد نصت المادة الثانية منه على أن (يعاقب بالحبس كل من يقوم بالتأثير على أعمال التصعيد الشعبي …)، وهو ما حرصت كل القوانين الانتخابية الصادرة في ليبيا بعد 2011 على إدراجه في باب الجرائم الانتخابية.
ولعل من المهم الإشارة إلى خلو القوانين من تجريم لسلوكيات تساعد على الفساد، فمثلًا لا يوجد حظر فعال ودقيق يمنع الموظف العام من الجمع بين الوظيفة العامة والعمل في القطاع الخاص، خاصة إذا كان العمل له صلة مباشرة بالوظيفة العمومية، كما أنه لا يوجد حظر على متقلدي المناصب الكبرى يمنعهم من مباشرة عمل خاص بعد تركهم مباشرة لمنصب مرتبط بمنصبهم السابق.
2.8.2 السلطة القضائية
لعل من مظاهر البيئة القضائية المساعدة على نمو الفساد ضعف فاعلية إنفاذ القانون، وصدور أحكام قضائية تحت قبضة مليشيات مسلحة، ناهيك عن إقصاءٍ للأكفاء ومن ثم تصدر المشهد القضائي من هم أقل كفاية، واستخدام القانون أداةٌ خطيرة في يد من لا يحسن استخدامها، وتلك عوامل مؤثرة في تفشي الفساد.
ولعل أكثر صور الفساد القضائي جسامة تتمثل في إصدار أحكام قضائية أو الامتناع عن إصدارها لأسباب سياسية، كما قد يتمثل الفساد القضائي في إساءة استخدام السلطة القضائية من قبل وكيل النيابة العامة بإجراءات القبض والتفتيش والتعذيب، وهو ما ترتب عنه قيام الضحية بمقاضاته طلبًا للتعويض والإدانة والمخاصمة.
ويمكننا رصد عديد من المحاولات القضائية للتصدي للمفسدين، ولكنها تقف عند حد أوامر الضبط والإحضار ومثالها: إصدار النائب العام الليبي حزمة من قرارات الضبط في أواخر 2020 ضد عدد كبير من المسؤولين الليبيين بتهم فساد واستغلال المال العام والتربح وغيرها، تضمنت مدير مصرف ليبيا الخارجي، ومدير قطاع الاستثمار بالمصرف، بتهمة إصدار المصرف ما يقرب من 80 مليون دولار، في استثمارات غير مدرجة، ترتب عنها ضرر جسيم بالمال العام.
كما شملت أوامر القبض وزير الحكم المحلي المفوض ومسؤولين بدرجة وكلاء وزارة في المالية والتعليم والحكم المحلي والصحة وعميد بلدية بني وليد ووكيل وزارة تعليم، ووكيل وزارة مالية ومدير إدارة الحسابات بالوزارة نفسها ووكيل شؤون الديوان بوزارة الحكم المحلي، بحكومة الوفاق برئاسة فائز السراج.
كما أصدر النائب العام قرارًا بإيقاف رئيس وأعضاء مجلس الإدارة بصندوق التأمين الصحي العام عن العمل، بسبب قيامهم بالتحايل والتدليس على الجهات الرسمية لأغراض مشبوهة وتسببهم في إلحاق الضرر بالمال العام وإيقاع الضرر بالغير.
وفي 17 أكتوبر 2020، أمر رئيس قسم التحقيقات بمكتب النائب العام “الصديق الصور” بإيقاف أي معاملات مالية للجنة المشتريات الخاصة بمجابهة فيروس كورونا التابعة لوزارة الصحة التابعة لحكومة الوفاق برئاسة فائز السراج، نظرًا لوجود تجاوزات مالية طالت لجنة المشتريات الخاصة بمجابهة الجائحة.
2.8.3 السلطة التنفيذية
للسلطة التنفيذية دور في تفشي الفساد من حيث إنها المسؤول الفعلي عن تفعيل وسيلة السلطة التشريعية البالغة الأهمية في مكافحة الفساد: “التشريع”، فهي المعنية بتنفيذ القوانين التي تصدرها تلك السلطة ولا قيمة لقانون تقره السلطة التشريعية إذا لم تنفذه السلطة التنفيذية أو إذا ما نفذته بطريقة غير ناجعة أو شكلية لا تحقق مضمونه وأهدافه، ناهيك عن قبضها على صلاحيات التصرف بمعظم المال العام؛ مما يجعلها اللاعب الأساسي في وجود الفساد وفي مكافحته، فعلى سبيل المثال لا الحصر، نذكر السجال القائم بين رئيس مصلحة الأحوال المدنية و محافظ المصرف المركزي حينما أشار محافظ المركزي إلى وجود تزوير في منظومة الرقم الوطني وعدَّه سببًا لقراره بوقف صرف منحة أرباب الأسر، والمأزق القائم بين المصرف المركزي ومجلس النواب حول الشرعية والتبعية مما أثر سلبًا على احترام المركزي للتشريعات الصادرة عن النواب قانون رقم 7 لسنة 2015 بشأن تعديل قانون رقم 1 لسنة 2013 بشأن منع المعاملات الربوية مثلا.
2.9 السياقات التشريعية في مواجهة الفساد
2.9.1 تنظيم دستوري
صدر الإعلان الدستوري 2011 بدون إشارة صريحة إلى الفساد أو مكافحته، وإن لم يخل من إشارة لبعض آليات النزاهة (المادة 6 المساواة في تكافؤ الفرص/ المادة 8 تضمن الدولة تكافؤ الفرص)
أما في مشروع الدستور الصادر في 2017، فقد زادت الإشارة إلى آليات النزاهة وضوابطها، أكدت المادة 15 أن من أسس الاقتصاد الليبي الشفافية والجودة والمساءلة، المادة 16 فهي مخصصة لتأكيد مبدأ تكافؤ الفرص للمواطنين، المادة 17 تجعل من الجدارة والاستحقاق معايير لتولي الوظيفة العامة، وتذهب المادة 21 إلى أن تؤسَّس وتدار مرافق الدولة بالحوكمة الرشيدة والنزاهة،
وقد ذهب مشروع الدستور إلى أبعد من ذلك من خلال مادته 23 المعنونة بمكافحة الفساد، إذ ألزم الدولة باتخاذ التدابير اللازمة لمكافحة الفساد الإداري والمالي وكشف حالاته ومعالجة آثاره، كما أنها نصت على عقوبة تكميلية مفادها الحظر على من يحكم عليه في جنحة أو جناية فساد تولي الوظائف في الحالات التي يحددها القانون، ولم يغفل مشروع الدستور عن دسترة هيئة شفافية مستقلة لمكافحة الفساد في المادة 163 منه.
إلا أن مشروع 2017 لم يحتوِ على نص بعدم سقوط جرائم الفساد بالعفو أو بالتقادم، كما أنه لم يلزم الدولة بمراجعة عقود الاستثمار التي تتوافر بشأنها قرائن فساد مالي أو إداري رغم أهمية هذه المراجعة بوصفها آلية من آليات العدالة الانتقالية، وقد كانت مسودة 2016 تحتوي الحكم بالمراجعة في المادة 207 منها وقد حذف النص من المسودة الأخيرة لمشروع الدستور.
وفيما يتعلق بالاتفاقات السياسية الحاكمة الموجهة للسياسات العامة فقد لمسنا تراجعًا في اتفاق 2021 عن اتفاق 2015 فيما يتعلق بمواجهة الفساد؛ ففي حين قرر الاتفاق السياسي 2015 بأن تحرص حكومة الوفاق الوطني على تمكين الأجهزة الرقابية، مثل: ديوان المحاسبة واللجان البرلمانية من متابعة أداء الحكومة وتقويمه خلال تنفيذها لبرنامجها وانعكاسه على الميزانية المقررة من خلال تقديم التقارير الدورية ودعم آليات مكافحة الفساد وإرساء ممارسات فعالة تهدف إلى الشفافية ومكافحة الفساد (البند الأخير في الملحق الخامس المتعلق بمبادئ السياسة المالية وإدارة الأصول الوطنية) وأكد أن الإعمار يجب أن يراعي المعايير الدولية للمساءلة والشفافية ومكافحة الفساد (الرقم 9 من الأولويات الاقتصادية)، وعَدَّ من المبادئ الحاكمة الالتزامَ بمبادئ الشفافية ومكافحة الفساد في كل تعاقدات الدولة وتعاملاتها الداخلية والخارجية (بند 30 )، في حين اكتفت خارطة الطريق 2021 بأن جعلت مكافحة الفساد هدفًا من أهدافها الثانوية (الفقرة 6/2 من المادة الأولى) وتعمل السلطة التنفيذية على مكافحة الفساد والتعاون الفعال مع الأجهزة الرقابية خلال المرحلة التمهيدية للحل الشامل (الفقرة 7 من المادة 6).
2.9.2 إصدار تشريعي
ورثت الدولة الليبية في المرحلة الانتقالية ترسانة من قوانين مكافحة الفساد، وقد عملت على تأكيد سريانها والنص عليها في القوانين الصادرة بشأن الفساد بعد 2011، وقد ينظر لذلك المسلك التشريعي بعين الرضا لما فيه من إعمال لمبدأ المراكمة، بيد أن تعذر الرضا عنه يرجع إلى أن مبدأ المراكمة يتجاوز عدم إهمال التركة السابقة إلى إعمال النظر فيها وتنقيحها إذا لزم الأمر ذلك، وهو ما غفل عنه مشرع المرحلة الانتقالية على الرغم من تعدده إلى ثلاثة مجالس تشريعية متعاقبة (مجلس انتقالي/ مؤتمر وطني/ مجلس نواب).
فقد تعددت القوانين الليبية المعنية بمكافحة الفساد قبل 2011 ومنها؛ بداية بقانون العقوبات العام ثم القوانين الخاصة المكملة ومنها: قانون الجرائم الاقتصادية رقم 2 لسنة 1979، قانون إساءة استعمال الوظيفة أو المهنة رقم 22 لسنة 1985، قانون الوساطة والمحسوبية رقم 5 لسنة 1985، قانون (من أين لك هذا) رقم 3 لسنة 1985، قانون التطهير رقم 10 لسنة 1994، قانون مكافحة غسل الأموال رقم 2 لسنة 2005، قانون رقم 1 لسنة 2005 بشأن المصارف، وآخرها قانون 5 لسنة 2010 بشأن المصادقة على اتفاقية مكافحة الفساد.
وهي مجموعة تشريعية تتميز بأنها قد صدرت في حقب زمنية مختلفة، كما أن بعضها عام والآخر خاص، وكلها موضوعية من حيث الأحكام، ومن ثمة كان من حسن السياسة التشريعية أن ينظر إليها، وتضم بين طيات تشريع واحد خاص بمكافحة الفساد.
ملامح السياسة التجريمية:
تتفق جميع هذه القوانين في المعاملة الجنائية العامة من حيث اعتبار المحل القانوني للحماية الجنائية هو المصلحة العامة، وأن جرائم الفساد هي من الجرائم الإدارية المالية، التي ترتكب ضد مصالح الدولة الليبية، بل إن القضاء الليبي لم يتوانَ عن اعتبار القيام بالتصديق الضريبي على عقود شركة أجنبية بالمخالفة للقانون من قبيل الأعمال الضارة بمصالح البلاد.
وتتنوع صور السلوك الإجرامي الذي يوصف بالفساد إذ يشمل، كل مساس بالمال العام مساسًا مباشرًا أو غير مباشر، بأي وسيلة ارتكب، ويمكننا التمثيل بما جاء في اختصاصات هيئة مكافحة الفساد حيث تقضي باختصاصها في كل من:
الجرائم ضد الإدارة العامة، والجرائم المخلة بالثقة العامة، وجرائم غسل الأموال، والجرائم الاقتصادية بما فيها الرشوة، وجرائم إساءة استعمال الوظيفة أو المهنة، والمخالفات لقواعد العقود الإدارية والمناقصات والمزايدات، كما تشمل المخالفات الإدارية والمالية التي يرتكبها الموظفون العامون، وجرائم الوساطة والمحسوبية، ويلاحظ على القانون الليبي أنه قد أورد في المادة الأولى من القانون رقم 6 لسنة 1985 بشأن تجريم الوساطة والمحسوبية بوصفهما تعاريف مترادفة لسلوك واحد، وهو كل ما من شأنه التأثير في استحقاق منفعة أو خدمة تقدمها الأشخاص الاعتبارية العامة والخاصة ذات النفع العام، بقصد منعها أو تعطيلها، أو الإخلال بحق الأولوية في الحصول عليها، وهو ما أكده في المادة السادسة عشرة من قانون رقم 10 لسنة 1994 بشأن التطهير.
وعلى سبيل معايرة هذه السياسة الجنائية الليبية بصور التجريم المنصوص عليها في اتفاقية الأمم المتحدة لمكافحة الفساد، تلك الاتفاقية التي عدّت من جرائم الفساد: الرشوة حتى في مجال القطاع الخاص، والمتاجرة بالنفوذ والاختلاس والتبديد حتى في القطاع الخاص، وإساءة استغلال الموظف العمومي وظائفه أو مهام منصبه، وإثراؤه غير المشروع، وغسل العائدات الإجرامية. يتضح أن الاتفاقية توسعت في التجريم أكثر من القانون الليبي الذي لم يدخل في دائرة التجريم أفعال الموظف في القطاع الخاص في قوانينه المتعاقبة كلها، ومن هنا نناشد المشرع الليبي بتحديث سياسته الجنائية من خلال اعتماد مشروع قانون مكافحة الفساد.
إذ إن الفساد في مفهوم القانون الليبي يستلزم جانيًا موصوفًا بصفة الموظف العام، ويعرف قانون العقوبات الليبي الصادر في 1954 والنافذ إلى الوقت الحالي في الفقرة الرابعة من المادة السادسة عشرة الموظف العام بأنه “كل من أنيطت به مهمة عامة في خدمة الحكومة أو الولايات أو الهيئات العامة الأخرى سواء كان موظفا أو مستخدما دائمًا أو مؤقتًا براتب أو بدونه …..” ويضيف في المادة 229 مكرر ج “رؤساء وأعضاء الهيئات النيابية أو المحلية سواء كانوا منتخبين أم مختارين، ورؤساء وأعضاء مجالس إدارة وموظفو الشركات وما في حكمها إذا كانت الدولة تساهم في رأس مالها”، بيد أن قانون التطهير رقم 10 لسنة 1994 يوسع من دائرة الجناة بحيث تشمل “القضاة وأعضاء النيابة ومكتب الادعاء الشعبي وغيرهم من أعضاء الهيئات القضائية وكذلك المحامون ومحررو العقود والأطباء والمحكمون والخبراء والمترجمون والضباط وأفراد الشعب المسلح والشرطة وحرس الجمارك والحرس البلدي والتفتيش الزراعي وغيرهم ممن لهم صفة الضبط القضائي والعاملون بالهيئات العامة والخاصة ذات النفع العام …”.
ويجدر بنا الإشادة بقانون رقم 3 لسنة 1986 بشأن “من أين لك هذا” حيث تجريمه لفعل أي شخص يكتسب مالًا أو منفعة أو مزية مادية أو معنوية مصدرها المحاباة أو التهديد أو مخالفة القانون أو كان الكسب مجهول المصدر أو لا يتناسب مع الموارد المشروعة للشخص (المادة الأولى منه) والقانون رقم 10 لسنة 1994 بشأن “التطهير” الذي أخضع لأحكامه كل من يحمل ترخيصًا لمزاولة مهنة أو حرفة أو صناعة أو عمل سواء بمفرده أو ضمن تشاركية وكذلك من يزاول أي نشاط اقتصادي بدون ترخيص (المادة الأولى منه).
وبشأن جريمة الرشوة، المنصوص عليها في المواد (21 وما بعدها) من قانون الجرائم الاقتصادية تتفق السياسة الجنائية الليبية مع دعوة اتفاقية الأمم المتحدة لمكافحة الفساد في المادة 16 منها إلى تجريم صور السلوك المختلفة للرشوة من الموظفين العموميين والقائمين بالخدمة العامة وشملت تلك الصور الوعد بالرشوة أو عرضها أو منحها لأي من هؤلاء، سواء لصالحه أو لصالح هيئة أو شخص آخر مقابل قيامه بفعل أو الامتناع عن فعل في نطاق مهامه الرسمية، وشملت أيضًا صورة طلب الرشوة والاشتراك في أي من صورها، ولعل من المميز في تلك الاتفاقية اهتمامها بدعوة الدول إلى تجريم صور الرشوة إذا ارتكبها موظف عمومي أجنبي أو موظف مدني دولي، وهو ما يعد خطوة هامة في مجال تجريم الرشوة الدولية، وذلك في المادة 17 منها.
وللرشوة صور كثيرة عصية عن الحصر؛ فهي قد تكون بتقديم الهدايا المالية والعينية والمعنوية وقد تكون رشوة جنسية أو رشوة إدارية أو أي منفعة تحقق مصلحة شخصية. ولعلّ أكثرها خطورةً ما يسمى بالرشوة الإدارية السياسيّة: فهي إداريّة من حيث المحلّ. فالرشوة تتمثل في تلك الوظيفة التي يعين فيها المواطن غير الكفء أو غير الجدير بها أو على أقل تقدير غير المفيد فيها. وهي سياسية؛ لأنها تمنح من أجل حصول المانح على ميزة أو عطية سياسية تتمثل في تحشيد الأصوات الداعمة لموقفه السياسي، سواء كانت هذه الأصوات عائدة لأبناء عائلة المستفيد منها وقبيلته أم عائدة لأبناء منطقته ومدينته.
كما جرمت الاتفاقية فعل التبديد أو التسريب للممتلكات والأموال والأوراق المالية العامة، وذلك في المادة 17 منها. والاتفاقية تدعو إلى تجريم الرشوة والاختلاس في القطاع الخاص في المادتين 20و21 وهو ما لا نجد تبنيًا له في التشريع الليبي.
كما جرمت المادة 18 من الاتفاقية المتاجرة بالنفوذ وحددتها بوعد للموظف العمومي أو قبول الموظف العمومي بأي مزية غير مستحقة استحقاقًا مباشرًا أو غير مباشر لتحريضه على القيام باستغلال نفوذه الفعلي أو المفترض بهدف الحصول من الإدارة على مزية غير مستحقة للشخص المحرض، أما المادة 19 منها فجرمت إساءة استغلال الوظيفة وهي القيام أو عدم القيام بفعل ما أثناء الاضطلاع بالوظيفة بغية الحصول على مزية غير مستحقة لصالحه أو لصالح شخص أو كيان آخر، وهو ما قد جرمه المشرع الليبي بالفعل في نص المادة 30 من قانون الجرائم الاقتصادية.
بينما جرمت المادة 20 منها تعمد الموظف العمومي إثراء غير المشروع، بمعنى زيادة ممتلكاته زيادة كبيرة لا يستطيع تعليلها بصورة معقولة قياسًا إلى دخله المشروع، وهو ما تصدى له المشرع الجنائي الليبي في قانوني (من أين لك هذا) والتطهير.
ومن نافلة القول الإشارة إلى أن جرائم الفساد جرائم ذات نتيجة مادية، وهي الضرر الذي يصيب المصلحة العامة جراء السلوك المادي، وبالرغم من أن أغلب صور سلوكها إيجابية، فإن المشرع حظر عديدًا من صور الفساد السلبية، ولعل منها تقصير الموظف العام في حفظ المال العام أو صيانته المكلف بحفظه (المادة 15 من قانون الجرائم الاقتصادية).
ويلاحظ على المشرع الليبي توسعته لدائرة الحماية في مواجهة الفساد إذ جرم كثيرًا من السلوكيات المرتبطة بسلوك الموظف المفسد؛ كتجريمه لفعل من يعرض على الموظف العام عطية أو حتى وعدًا بعطية لاحقة، وإن لم يقبل منه ذلك (المادة 22 من قانون الجرائم الاقتصادية) بل إنه عاقب مجرد من أخذ العطية بقصد إيصالها للموظف مع علمه بأنها رشوة (المادة 26 من القانون سالف الذكر).
سن الجزاءات في مواجهة الفساد
تتعدد الجزاءات الجنائية المنصوص عليها في القوانين الليبية وصولًا لعقوبة الإعدام عن فعل التخريب العمدي للمنشآت النفطية أو إحدى ملحقاتها (المادة 4 من قانون الجرائم الاقتصادية )، بيد أن غالبية صور الفساد تواجه بالعقوبات السالبة للحرية التي تتراوح بين السجن والحبس حسب جسامة الضرر وخطورة الجاني، ولعل من المفيد أن ننبه المشرع الجنائي إلى تشكيك علماء السياسة الجنائية في نجاعة العقوبات السالبة للحرية قصيرة المدى والدعوة لإيجاد بدائل مناسبة تتلافى عيوبها الكثيرة الذي يضيق المجال عن ذكرها، ومن البدائل المفيدة جدًا للجاني في بعض جرائم الفساد وللمجتمع الليبي حاليًا – عقوبة العمل للمنفعة العامة.
كما يلاحظ اعتماد المشرع الجنائي على عقوبة الغرامة العادية التي قد تصل إلى خمسين ألف (قانون المصارف رقم 5 لسنة 2005) وتبدو هذه القيمة المالية للغرامة غير متناسبة مع جسامة الضرر متى قدرت حصيلة جريمة الفساد بالمليارات، ولذلك يفضل تبني المشرع الغرامات النسبية إضافة إلى تأكيد رد المال وتعويض الدولة عن الأضرار التي لحقت بالمصلحة العامة، ونجد مثالًا على ذلك في نص المادة 9 من قانون الجرائم الاقتصادية (غرامة ألف دينار ولا تزيد على قيمة الضرر وبالتعويض عن الأضرار الناجمة بالمال العام أو المصلحة العامة)، كما نصت على ذلك المادة 35 من القانون سالف الذكر( يحكم على الجاني … بغرامة تعادل ضعف ما هرب أو اختلس أو طلب أو قبل أو وعد به أو عرض عليه أو حصل عليه أو استولى عليه أو أرغم غيره على إعطائه، ومصادرة أو رد المبالغ التي حصل عليها بسبب ارتكابه الجرائم المبينة في المواد المشار إليها في هذه المادة) وقد وردت العقوبة التكميلية برد الأموال في أكثر القوانين التي تجرم صور الفساد ومنها: قانون رقم 3 لسنة 1985 من أين لك هذا، فقد أوجبت المادة السادسة منه رد الأموال للخزانة العامة، وقانون رقم 10 لسنة 1994 بشأن التطهير، فقد نصت المادة الخامسة عشرة منه على وجوب قضاء المحكمة برد الزيادة في الأموال التي يثبت أنها كسب غير مشروع وتصبح حقًا للخزانة العامة.
وحرص المشرع الليبي على ذكر عديد العقوبات التبعية ومنها: الحرمان من الحقوق المدنية ( المادة 36 من قانون الجرائم الاقتصادية/ المادة 1 من قانون 22 لسنة 1985 بشأن محاربة إساءة استعمال الوظيفة أو المهنة والانحراف بأعمال التصعيد الشعبي/ المادة 24 من قانون 10 لسنة 1994 بشان التطهير)، نشر الحكم على نفقة المحكوم عليه (المادة 25 من قانون التطهير 10 لسنة 1994)، عدم الصلاحية للشهادة أمام القضاء وعدم الصلاحية لتولي شؤون الوصاية والقوامة وعدم الصلاحية لتولي أي وظيفة أو البقاء فيها وعدم منحه لشهادة حسن سيرة وسلوك (المادة 24 من قانون رقم 10 لسنة 1994 بشأن التطهير).
ولم يغفل عن سن عديد الجزاءات الاحترازية: المصادرة في بعض الحالات المشروطة، التجميد والحجز والتحفظ، قفل المصرف المركزي لحساب المصرف المخالف، سحب الترخيص وغلق المنشأة بالنسبة إلى الأشخاص الاعتبارية. ومن بين التدابير اللافتة في القانون الليبي؛ أن يترتب على صدور حكم نهائي بالإدانة وضع من تمت الوساطة أو المحسوبية لمصلحته في آخر قائمة المستحقين كما يحكم باسترجاع ما حصل عليه من منافع أو خدمات بسببها (المادة 25 من قانون رقم 10 لسنة 1994 بشأن التطهير).
ومن بين التدابير الاحترازية الخطيرة في مواجهة الفساد المالي والإداري والسياسي ما قرره المجلس الانتقالي في قانون رقم 36 لسنة 2012 بشأن إدارة أموال بعض الأشخاص وممتلكاتهم في ليبيا وخارجها وأبناء الأشخاص “الطبيعية” منهم وأزواجهم، الذي أدرج جداول بأسماء هؤلاء الأشخاص وتلك الأموال، مع تفويضه السلطةَ التنفيذية ممثلة في مجلس الوزراء بإضافة أشخاص أو أموال لم تشملهم تلك الجداول. وبالرغم من الطعن في هذا الحكم بعدم الدستورية لتعارض ما يحتويه من أحكام مع حقوق ومبادئ دستورية أصيلة، فإن الدائرة الدستورية في المحكمة العليا رأت غير ذلك، وهو ما أظنها قد جانبت فيه الصواب؛ فالقانون قد تمادى في الاعتداء بدون حكم قضائي على أموال المشتبه بهم وممتلكاتهم (الحالين والمحتملين) إلى درجة إجازته للحارس العام أن يبيعها بإذن من وزير العدل ( المادة الرابعة منه)، ولذلك لا يُعد من حسن السياسة الجنائية نص القوانين الجنائية على حق الدولة في تتبع المال في أي يد كانت ولو انتقل لذمة غير ذمة الجاني؛ لأنها وإن كانت ناجعة في الحد من الفساد وفي التقليل من مضار المصلحة العامة، ولكنها مهددة بالقضاء بعدم الدستورية؛ لأن هذه النصوص تُعد مخالفة لمبدأ شخصية العقوبة.
ومن الملاحظ أن المشرع قد تبنى سياسة جنائية رشيدة مفادها تبنيه لفكرة العفو من العقاب إذا قام الجاني بالإبلاغ عن جريمة غسل الأموال قبل اكتشافها من الجهات المختصة (المادة 5 من قانون 2 لسنة 2005 بشأن غسل الأموال)، ولعل في تعميم هذه السياسة على صور جرائم الفساد الأخرى فيه من الفوائد الاقتصادية الكثير بما يحقق المصلحة العامة للدولة الليبية محل الحماية الجنائية، قبل اكتشافها من الجهات المختصة.
تعامل الجهات القضائية مع الصور الإجرامية للفساد محفوف بالمصاعب؛ وذلك يرجع لعوامل كثيرة لعل أهمها ما تتميز به جرائم الفساد من خصائص تتعلق بجانيها وبضحيتها وبظروف ارتكابها ؛ فالجاني في جرائم الفساد موظف عمومي يرتكبها مستفيدًا من سلطاته الفعلية وامتيازاته القانونية بما يمكنه من توفير غطاء لجريمته، فهي من جرائم ذوي الياقات البيضاء المتمتعين بميزات الجاني القوي في مواجهة جهات الرقابة والتحري، لا سيما مع وجود الكم الهائل من الحصانات التي تعيق حرية النيابة في رفع الدعوى أمام القضاء، والتي يحرص القطاع الواسع من موظفي الدولة على الدفع بها في مواجهة أي إجراء يراد به كشف وقائع الفساد ويساعدهم على ذلك التناقض بين قواعد القانون الجنائي المجرمة لصور الفساد فيما يتعلق بقيود الأذن والطلب والشكوى؛ فحين يستلزمها البعض (المادة 10 من قانون الجرائم الاقتصادية) يرفعها عن النيابة العامة البعض الآخر(المادة السابعة من قانون 23 لسنة 1985 من أين لك هذا/ المادة الثامنة عشرة من قانون 10 لسنة 1994 التطهير).
كما أن جرائم الفساد ضحيتها ليس شخصًا طبيعيًا؛ فهي تقع في الغالب على شخص اعتباري “الدولة ومرافقها وأموالها”؛ مما يضعف أحيانًا من الحافز الفردي على الملاحقة لغياب الأذى المباشر الناشئ عن الجريمة ويلقي بالعبء كله على جهات الرقابة والتحري.
مما يميز جرائم الفساد أيضًا أنها جرائم مخبوءة عصية علي الكشف والضبط، ولعل أغلب حالاتها ترتكب في الكتمان وتنتمي لجرائم الرقم الأسود الذي لا يظهر في الإحصائيات، وبشأن إثباتها سنجد معضلة حقيقية وهي مشكلة عدم إفشاء سر المهنة؛ إذ إنّ مقدم البلاغ غالبًا ما يكون موظفا عامًا في إحدى المؤسسات التي يمارس داخلها الفساد، وبفرض أن كان مقدم البلاغ مواطنًا عاديًا، فالوضع لا يقل خطورة مما يجعل الكثير يحجم عن القيام بالإبلاغ بذلك لكثير من الصعاب التي تحيط بهذا الإجراء، لعل أهمها تحوله إلى متهم في جريمة البلاغ الكاذب أو جريمة التشهير ما لم يُقِم الدليل على صحة ما أسنده أو شهر به في مواجهة من يدعي فساده (المادة 440 من قانون العقوبات) ولعلها الحالة الوحيدة التي ينتقل فيها عبء الإثبات من عاتق النيابة إلى عاتق المتهم .ومن الظلم أن يطلب من المواطن مستندات ووثائق تثبت فساد بعض الأشخاص النافذين في الدولة خاصةً.
وفيما يتعلق بالآليات الإجرائية لمكافحة الفساد يثار تساؤل حول مسألتين تتسمانِ بالفاعلية في مواجهة الفساد الأولى محلية تتعلق بكفاية الأجهزة الرقابية الكاشفة عن الفساد والثانية دولية تتعلق بسبل مواجهة الفساد العابر للنطاق الإقليمي للإجراءات الجنائية الليبية.
