المسار القضائي للدفاع عن حقوق مزدوجي الجنسية في ليبيا

الهدف من حراكنا في “اتحاد الليبيين المغتربين” هو الدفاع عن الحقوق الدستورية والسياسية لمزدوجي الجنسية من الليبيين، وبالتالي لا مفر من الطعن في القانون المعيب أمام الدائرة الدستورية في المحكمة العليا، وربما الطعن في أحكام قضائية اعتمدت على مواد القانون المعيب أمام إدارة القضايا بالمجلس الأعلى للقضاء.

أولا: الطعن في قانون 24 لسنة 2010

أهم مواد القانون رقم 24 لسنة 2010م بشأن أحكام الجنسية الليبية المستهدفة بالطعن هي المادة الخامسة التي تنص على أنه : “يفقد الجنسية الليبية من يكتسب باختياره جنسية أجنبية ما لم تأذن له بذلك اللجنة الشعبية العامة للأمن العام”.

وفي ما يلي أهم بنود الطعن:

أـ القانون يفتقد للشرعية لصدوره في زمن الاستبداد

القانون صدر قبل ثورة فبراير وهو يتناقض في روحه مع نصوص الإعلان الدستوري التالية:

المادة (6) ـ “الليبيون سواء أمام القانون، ومتساوون في التمتع بالحقوق المدنية والسياسية، وفي تكافؤ الفرص وفيما عليهم من الواجبات والمسؤوليات العامة، لا تمييز بينهم بسبب الدِّين أو المذهب أو اللغة أو الثروة أو الجنس أو النسب أو الآراء السياسية أو الوضع الاجتماعي أو الانتماء القبلي أو الجهوي أو الأسرى” .

المادة (7) ـ “تصون الدولة حقوق الإنسان وحرياته الأساسية وتسعى إلى الانضمام للإعلانات والمواثيق الدولية والإقليمية التي تحمي هذه الحقوق والحريات وتعمل على إصدار مواثيق جديدة تكرم الإنسان كخليفة الله في الأرض” .

المادة (34) ـ “تُلغى الوثائق والقوانين ذات الطبيعة الدُّستُورية المعمول بها قبل العمل بهذا الإعلان”. ولا شك في أن مسألة الجنسية هي ذات طبيعة دستورية بامتياز، فمصطلح “الجنسية” ملازم لحق المواطنة ويعبر عنها وهو حق مقدس وأكبر من أن يفقده المواطن لسبب إجرائي روتيني مثل عدم قدرته على الحصول على إذن من وزارة الداخلية لأي سبب من الأسباب.

ب ـ القانون استهدف حقوق مواطنين ليبيين

القانون إستهدف الليبيين المغتربين وعلى رأسهم المعارضين لنظام القذافي بهدف تهميشهم ونزع الجنسية الليبية منهم أو لعزلهم قانونيا على أقل تقدير، ولذلك اشترط الحصول على إذن من اللجنة الشعبية العامة للأمن العام وفي تلك المرحلة كان جهاز الأمن الداخلي هو المكلف بمتابعة مزدوجي الجنسية المعارضين للنظام الدكتاتوري، وقد كانوا معرضين للتحقيق والتعذيب والإعتقال والسجن لسنوات عديدة بدون أي تهمة وربما للتصفية الجسدية.

ج ـ القانون افتقد أي مرجعية دستورية

الدول المتقدمة تحترم علوية الدستور على بقية القوانين ولكن الدول الشمولية كما في ليبيا قبل ثورة فبراير تصدر قوانينها دون الرجوع إلى أي مرجعية دستورية، ومن المعلوم أن القذافي ألغى الدستور وكل القوانين الصادرة عنه في العهد المملكي. وكان الأولى بالمؤتمر الوطني العام إلغاء العديد من هذه القوانين المجحفة والتي منها القانون قيد البحث، وكان من واجب الذين وضعوا قوانين الانتخابات عدم الإشارة لهذا القانون في التوطئة لتلك القوانين.

د ـ القانون لا ينطبق على أغلب مزدوجي الجنسية

نص المادة الخامسة من قانون 24 لسنة 2010 لا ينطبق على أغلب مزدوجي الجنسية لسببين:

أولا لأنهم تحصلوا على الجنسية الأجنبية قبل صدور القانون بسنوات وبعضهم بعقود من الزمن،

وثانيا لأنهم تحصلوا على الجنسية الأجنبية مضطرين ومكرهين وليس باختيارهم وبرغبتهم.

هـ ـ هناك سوابق كثيرة بعدم تطبيق القانون

كل قوانين الإنتخابات السابقة لم تعر أي اهتمام للقانون رغم وجوده في ديباجة كل منها، وهناك العديد من السوابق التي ترقى إلى قرائن تدل على نجاعة  مخالفته وعدم تطبيقه، ومن هذه القرائن:

ـ سكوت الإعلان الدستوري عن مسألة إزدواجية الجنسية

ـ عدم تطبيق القانون رغم النص عليه في ديباجة كل قوانين الإنتخاب، حيث هناك العديد ممن تقلدوا المناصب السيادية في المؤتمر الوطني العام، وفي الهيئة التأسيسية لصياغة مشروع الدستور، وفي مجلس النواب.

ـ تجاهل كل الحكومات الإنتقالية للقانون حيث قامت بتعيين العديد من مزدوجي الجنسية في مناصب قيادية ولم يتم الطعن في قرارات تعيينهم، سواء على مستوى المكتب التنفيذي وفي رئاسة ومجالس الحكومات الإنتقالية، وأيضا في مخرجات اتفاقية الصخيرات كالمجلس الرئاسي وحكومة الوفاق الوطني وفي مخرجات منتدى الحوار الليبي في جينيف والشواهد موجودة في المجلس الرئاسي وحكومة الوحدة الوطنية.

ثانيا: الطعن في مصادرة حقوق مزدوجي الجنسية في مشروع الدستور الجديد

هناك نصوص متضاربة حول حقوق مزدوجي الجنسية بين مسودتي مشروع الدستور لعام 2016 و 2017.

أ ـ مسودة مشروع الدستور لسنة 2016 (التي لم تعتمد لأسباب غامضة)

جاءت بعض مواد مسودة 2016 ضامنة لحقوق المواطن دون تمييز سلبي لمزدوجي الجنسية بدءً من المادة (9) بشأن المواطنة التي نصت على أن “المواطنون والمواطنات سواء في القانون وأمامه لا تمييز بينهم نقصانا أو تقييدا أو حرمانا، وفق أحكام هذا الدستور“

وجاءت المادة (12) بشأن الجنسية في مسودة 2016 بنص واضح في الفقرة الثالثة على أنه “يجوز الجمع بين الجنسية الليبية وأي جنسية أخرى” وهذا ما لم ينص عليه مشروع دستور 2017، وهذه المادة أعطت للمواطن الحق في الحصول على جنسية أخرى دون اشتراط موافقة وزارة الداخلية كما ورد في القانون المعيب.

ويبدوا أن الهيئة كانت تمر بمرحلة صراع “كسر العظم” بين أعضائها وربما كان من خطواته الطعن أمام محكمة البيضاء في رئاسة وعضوية الدكتور علي الترهوني من قبل عضو الهيئة ضو المنصوري، وبالتالي تم تجاهل مسودة 2016 وانعكس هذا الصراع على مواد مشروع الدستور المعتمد في مايو 2017 .

كما نصت المادة (14) بشأن إسقاط الجنسية وسحبها في مسودة 2016 على أنه “يحظر إسقاط الجنسية الليبية لأي سبب كان. ويجوز سحبها ممن أكتسبها خلال العشر سنوات التالية لإكتسابها. ويبين القانون حالات السحب وآثاره”. هذه المادة حظرت اسقاط الجنسية الليبية عن المواطن الليبي لأي سبب كان، وحصرت أمكانية سحب الجنسية في الذين اكتسبوها خلال عشر سنوات لحالات ينص عليها القانون.

أما المادة (48) بشأن حق التصويت والترشح في مسودة 2016 نصت بأن “لكل مواطن حق التصويت في الاستفتاءات والتصويت والترشح في انتخابات حرة ونزيهة وشفافة وعادية يتساوى فيها المواطنون كافة وفق القانون. ويحظر حرمان المواطنين من ذوي الأهلية منها إلا بحكم قضائي.” هذه المادة لم تضع أي استثناء في أي انتخابات بنزع حق التصويت والترشح عن مزدوجي الجنسية وتركت الأمر إلى مواد الدستور التي تنص على شروط الترشح للمناصب السيادية.

ب ـ مشروع الدستور المعتمد لسنة 2017 والمطروح للإستفتاء

أحد أعضاء الهيئة التأسيسية لصياغة مشروع الدستور، الدكتور ابراهيم البابا، في تغريدة له نُشرت يوم 25 أبريل 2021 على صفحته الخاصة عنونها بـ (إزدواج الجنسية في مشروع الدستور الليبي)، ذكر فيها بأنه لا علاقة لمسألة ازدواج الجنسية عند بعض الليبيين بالوطنية، بل إن الكثير منهم (مزدوجي الجنسية) قضى جل حياته للنضال من أجل قضايا بلده ليبيا.

واستطرد قائلا .. لقد تعامل مشروع الدستور الليبي لسنة 2017 مع مسألة ازدواج الجنسية وفق الآتي:

– الأصل هو انه لا يوجد نص في مشروع الدستور يمنع ازدواج الجنسية، على عكس ما ورد في دستور  1951 في المادة (10) الذي يمنع الجمع بين الجنسية الليبية او أي جنسية أخرى.

– حظر مشروع الدستور “مؤقتا” بعض الوظائف السيادية كرئيس الجمهورية وأعضاء مجلسي النواب والشيوخ والحكومة، وينتهى هذا الحظر بالتنازل عن الجنسية الأخرى، وهو عكس ما ورد في الدستور المصري مثلاً من حظر “دائم” حيث أشترط فيمن يترشح رئيسًا للجمهورية أن يكون مصريًا من أبوين “مصريين، وألا يكون قد حمل، أو أي من والديه أو زوجه جنسية دولة أخرى (المادة (141))

أصاب الدكتور في أن مشروع الدستور سكت عن المسألة ولم ينص عن منع إزدواج الجنسية، وكنا نأمل أن يتم اعتماد النص الذي ورد في مسودة 2016. أما وصفه لحظر المشروع لمزدوجي الجنسية من الترشح بأنه حظر “مؤقت” فقد جانب الصواب. فالحظر المؤقت هو بمثابة “حظر تام” لأنه اشترط التنازل عن الجنسية الأخرى كشرط للترشح وليس كشرط لتقلد المناصب السيادية.

ذكر عضو الهيئة بأن مشروع الدستور جاء عكس ما ورد في الدستور المصري الذي وضع حضر دائم على مزدوجي الجنسية ممن يترشح رئيسا للجمهورية.

وكم كنا نتمنى من أعضاء هيئة صياغة مشروع الدستور الالتفات نحو الجارة تونس بدلا من مصر، حيث توافقت النخبة التونسية على دستور تناول مسألة إزدواج الجنسية بمهنية وواقعية وقد نص في الفصل (74) أن “الترشح لمنصب رئيس الجمهورية حق لكل ناخبة أو ناخب تونسي الجنسية منذ الولادة، دينه الإسلام”.

وجاء الشرط للترشح عقلانيا ومنطقيا حيت نص على أنه “إذا كان حاملا لجنسية غير الجنسية التونسية، فإنه يقدم ضمن ملف ترشحه تعهدا بالتخلي عن الجنسية الأخرى عند التصريح بانتخابه رئيسا للجمهورية“. ومن العقلانية أيضا أن الدستور التونسي لم يضع شروطا بإقصاء مزدوجي الجنسية من الترشح وتقلد المناصب السيادية الأخرى.

وبما أن حق المشاركة السياسية هو “أبو الحقوق” الذي ضمنته القوانين الدولية، كان من الأفضل على مشرعي مشروع الدستور الليبي ألا يمنع مزدوجي الجنسية من ممارسة حقهم في الترشح لأي منصب، وكان من المنطقي أن يشترط على المترشح بأن يتعهد بالتنازل عن الجنسية الأخرى عند فوزه في الإنتخابات، وحينها يكون قد ضمن للمواطن حقه في الترشح، وضمن للنظام السياسي حقه في وضع شروط لتقلد المناصب السيادية.

نخلص إلى أن مشروع الدستور المتوافق عليه بصيغته الحالية قد وقع في فخ الكيدية السياسية بمصادرته حق الترشح للمواطنين من مزدوجي الجنسية داخل ليبيا وخارجها، مقابل أن يمنع عدد قليل من الراغبين منهم للترشح وتقلد المناصب السيادية، وليس من المبالغة البوح بأن الأغلبية الساحقة من مزدوجي الجنسية لا يرغبون في تقلد المناصب السيادية أو أي مناصب حكومية ولكنهم يصرون على الدفاع عن حقوقهم الدستورية والسياسية والمدنية التي يتمتع بها بقية المواطنين الليبيين.
