الأشخاص عديمو الجنسيّة في القانون الليبيّ

ما الذي يعنيه أن يعيش إنسانٌ ما، في البلد التي وُلِدَ فيه وترعرع به هو وأهله، ولا يعرف غيره وطنا ولا سكنا، دون أن يكون مواطنا، ولا حاملا الجنسيّة؟

ببساطة، يعني ذلك، أنّ كلّ الحقوق المدنيّة والسياسيّة ستكون مفقودة؛ ابتداء من أبسط المعاملات الأساسيّة والضروريّة، كفتح حساب في مصرف أو حسابٍ في جمعيّة استهلاكيّة، إلى أعقدها كالمشاركة في الانتخابات، ترشيحا وترشّحا. فكلّ هذه الممارسات والمعاملات في ليبيا، ترتبط ارتباطا وثيقا باعتراف الدولة بك، إنسانا ومواطنا.
مواطنون بلا حقوق

سعاد امرأة ليبية، تزوّجت من شخصٍ لا يتمتّع بالجنسيّة الليبيّة، فأوراقه لا تزال بمكتب الصحراء الشرقية، الذي لم تعترف به إدارة القانون الليبيّ، واعتبرته مكتبا دخيلا على مكاتب السجلّ المدنيّ الليبيّة. أنجبت (سعاد) 5 أطفالٍ، لم يتم تسجيلُ أيّ منهم، في السجِلّات المدنيّة الليبيّة. (سعاد) وأطفالها اليوم، غير المعترف بهم قانونيّا، يعانون ظروفا اقتصادية صعبة خصوصا بعد وفاة زوجها، إثر رصاصة طائشة استقرّت في صدره.

أمّا (عامر) أو كما يناديه أصدقاؤه بالتشادي، فقد وُلِد في ليبيا لأبٍ يحمل الجنسيّة الليبيّة، وكلّ أخوته الأصغر منه سنّا يحملون الجنسيّة الليبيّة، ولكنّه لا يحمل الجنسيّة الليبيّة مثلهم!. يبدو الأمر محيّرا، أليس كذلك!

عامر وُلِد في ليبيا، ولكن قبل أن يأخذ أبوه الجنسيّة الليبيّة، والتي اكتسبها – أي أبوه – بالاختيار، في سبعينات القرن الماضي. لذا يعتبره القانون الليبيّ أجنبيّا؛ لكون مصلحة الجوازات والجنسية لم تعترف له بحق المُواطنة، فهم يرونه – مثلما يراه أصدقاؤه – تشاديّا، رغم أنّ (عامر) لم يزر تشاد يوما، ولا يعرف شيئا عنها، كما أنّه لا يحمل جنسيّتها، ولكن ترتّب على عدم حمله الجنسيّة الليبيّة، أن يعيش في بلده فاقداً للحقوق، بل وفاقدا لزوجةٍ أيضا؛ لأنّه لم يجد من يتقبّل/يفهم وضعه المعقد الذي وضعه القانون الليبيّ، فيه.

ماذا عن الجدّ (جبريل) رحمه الله، الذي توفي منذ أكثر من عقدٍ مضى؟. وُلِدَ في قطاع أوزو “شريط حدودي بين ليبيا وتشاد” سنة 1910م. وانتقلَ إلى مدينة طرابلس للعمل بها في ستينات القرن الماضي، وأنجب اثنا عشر ولداً، وهم بدورهم أنجبوا أولادًا، ليُنجِبَ أولادهم أولاداً. منهم الدكتور والمهندس والضابط.

كلّ أبناء وأحفاد الجدّ (جبريل) وأحفادهم، بعد سنة 1996م يُعتبَرون أجانبًا في نظر القانون الليبيّ! لماذا؟

لأنّه في سنة 1996م صدر قرارٌ من أمانة مؤتمر الشعب العام (ما يُعادل البرلمان وقتها) تقرّر فيه “أنّ كلّ من وُلد في إقليم أوزو يعتبر أجنبياً” لكون هذا “الإقليم” ضُمّ بموجب حكم محكمة العدل الدولية إلى دولة تشاد.

لذلك، سُحِبتْ جميع المستندات الليبيّة ممّن ولد في قطاع اوزو؛ ففقد الجدّ (جبريل) وأبناؤه وأحفاده وباقي أسرته اللاحقين الذين وُلدوا والذين لم يُولدوا بعد، الجنسية الليبية. وإلى الآن، عائلة جبريل لا يتمتعون بالجنسيّة الليبيّة ولا بأيّ رعويّة أجنبيّة أخرى، رغم أنّ عددهم فاق 120 فردا.

لمحة عن قانون الجنسيّة الليبيّ

إنّ طرق الحصول على الجنسيّة الليبيّة، مرّت بمراحل عديدة، عبر القوانين الخاصّة بها. فقانون رقم 17 لسنة 1954م قسّم الجنسيّة الليبيّة إلى جنسيّة إثبات في مادّته الاولى، وجنسيّة اختيار في المادّة الثالثة وما بعدها، وجنسيّة تجنّس في المادّة الخامسة.

أمّا القانون رقم 18 لسنة 1980م بشأن أحكام الجنسيّة، فقد صدر في خِضمّ تبنّي الدولة الليبيّة، القوميّة العربيّة. فجعل الجنسيّة العربية هي جنسيّة مواطني الجماهيرية العربيه الليبيّة سابقاً.

نصّت المادّة السابعة “تثبت الجنسية العربية للمواطنين الليبيّن بموجب شهادة إثبات الجنسية العربية”، وأقرّ القانون أنّ “الجنسيّة العربيّة هي حقٌّ لكلّ عربيّ، يدخل الأراضي الليبيّة، ويرغب في الحصول على هذه الجنسيّة، وذلك بأن يثبُت انتماؤه إلى إحدى الدول العربيّة، أو أن يثبُت انتماؤه أو أحد والديه للأمة العربية”

آخر هذه القوانين الفاعلة، كان قانون رقم 24 لسنة 2010م بشأن الجنسيّة، الذي أدمج جنسيّة الإثبات مع الاختيار كما هو منصوصٌ في مادّته السابعة، فجعل الجنسيّة الليبية هي جنسية مواطني الجماهيرية الليبية”.

نقدٌ قوانين الجنسية، الليبيّة: متى تُقدَّم الحقوق على السياسة؟

يُستفاد من القوانين سالفة الذكر، ونتائجها، أنّ المشرع الليبيّ – في نهاية أمره – أرجع الأمر إلى ما كان عليه سنة 1954م وجعل الجنسيّة الليبيّة هي جنسيّة المواطنين الليبين، وأنّ القوانين المتأثّرة بأفكار القوميّة العربيّة، لم تكن سِوى نزوة – في تقديري – تسبّبت في تركة من المشاكل والعراقيل لا يزال المشرّع الليبيّ، يُعاني منها، حتى الآن.

إضافة إلى أنّ إنشاء مكتب الصحراء الشرقيّة، في بداية سبعينات القرن الماضي، بتعليمات من القذّافي، والذي أنشئ لأسباب سياسيّة، أدّى إلى تفاقم أزمة الصحراء الشرقيّة، وتسبّب في ولادة جيل لم يعترف به المشرع الحالي كونه لم يستطع أن يُثبت الانتماء إلى الأصل الليبيّ، بعد أن كان الأصل العربيّ هو المطلوب للتجنّس.

ناهيك على أنّ المكتبّ – مكتب الصحراء الشرقيّة – ليس من إدارات ولا مكوّنات مصلحة الأحوال المدنيّة، مما جعل إدارة القانون في إحدى الآراء القانونية، تنصّ على أنّ “قدوم الأسر من مكتب الصحراء الشرقيّة إلى مكاتب السجلات المدنيّة يُعدّ مخالفاً للقانون” كون أنّ هذا المكتب لا يخضع للهيكل التنظيمي لمصلحة الأحوال المدنية ولا يعتبر مكوّنا من مكوّناته.

المفارقة، أنّ المشرع الليبيّ، أقرّ لمجهولي النسب الجنسيّة الليبية في قانون 5 لسنة 1424م (1997م) بشأن حماية الطفولة، وذلك في مادّته الثامنة “يُمنح الأطفال مجهولو النّسب أسماءً ثلاثيّة، ويسجّلون بسجلٍ معدٍ لذلك بمكتب السجل المدني المختصّ، ويحق لهم الحصول على البطاقات الشخصيّة وجوازات السفر، وكذلك كتيبّات العائلة، دون التقيّد بشرط إبرام عقود الزواج”.

ولا يزال السؤال معلّقا:

لماذا لا ينظر المشرّع الليبيّ إلى أبناء عديمي الجنسيّة، بنفس النظرة الحقوقيّة الإنسانيّة، التي نظر بها مجهولي النّسب؟

خاتمة: إنّ المشرّع الليبيّ لم يجد حلولا فعّالة؛ لإنصاف هؤلاء المضطهدين، فحقّ الجنسيّة هو أساس الحقوق التي يُبنى عليها العمل والتعليم والصحة، وضياع الجنسيّة يعني ضياع الإنسان وانتمائه.

وهذا الأمر يقرّه الشرع وحقوق الإنسان. على أمل أن يضع أصحاب القرار حلا جذريّا لمعاناة عديمي الجنسية.

فحقوق الإنسان واحدة لا تتجزّأ.
