فليس المقصود الأول سَنُّ التشريعات، وإنما تلبيتها لتطلعات المجتمع واحتياجاته، بالمحافظة على مصالحه ورعايتها من الناحيتين، الموضوعية والإجرائية، وليست العشوائية هي قيام هذه المحافظة، وإنما مراعاة لوازم العملية التشريعية.

كما أن عدم اتزان حركة التشريع، وتخبطها في الاهتداء إلى نهج تشريعي ملائم للنظام العام للمجتمع، متوازن مع أعرافه وتقاليده، ينعكس سلبا على مبدأي العدل والعدالة الاجتماعية، الأمر الذي تحكمه أسباب متعددة، منها ما يرجع إلى تأثير النظام الحاكم على سلطات الدولة، ومنها ما يرجع إلى تأثير سلطة التشريع بتوجهات أيدلوجية أو سياسية، ومنها ما هو فني محض متعلق بمن تناط بهم مهمة التشريع، ومنها ما يتعلق بأسلوب رعاية المصالح المحمية في المجتمع، ومنها ما يتعلق بمراعاة وإهمال التشريع ولوازمه، إلى غير ذلك من الأسباب.
